High Court Orders IG Douglas Kanja to Disclose Whereabouts of Missing Wajir MCA within 14 Days

Nairobi, January 23, 2025 – The High Court has issued a directive ordering Inspector General of Police Douglas Kanja to disclose the whereabouts of missing Wajir Member of County Assembly (MCA) Yusuf Hussein Ahmed within 14 days. The order was issued by Justice Chacha Mwita, who also directed the petitioners to serve the respondents within seven days.

The case was brought forward by the Law Society of Kenya (LSK), Wajir Governor Ahmed Abdullahi, and the MCA himself. The respondents in the case include the police IG, the Director of Criminal Investigations (DCI), the Director of Public Prosecutions (DPP), and the Attorney General, with the Independent Police Oversight Authority (IPOA) listed as an interested party.

Yusuf Hussein Ahmed, the Dela Ward MCA, went missing on September 13, 2024, while being driven along Enterprise Road in Nairobi’s Industrial Area. Despite a body being found in Lake Yahud a month later, DNA tests confirmed it was not Ahmed’s. This has led to widespread concern and calls for accountability from the State.

The court’s order comes amid growing pressure from the 47 County Assemblies, which threatened to adjourn House sittings if their colleague was not found. The MCAs claimed that Ahmed was taken in by the State for unknown reasons.
